TERMS & CONDITIONS

The agreement between you and Abigailswim.com on the following terms comes into force when you make a partial of full payment for a workshop or event, or place an order onsite at clubhouse or through our website . If you are unable to understand or have any questions, please contact us before you make any order. You will be required to confirm that you have read and accept these terms before you submit an order to us.

Bookings

Payment for all bookings shall be made in Hong Kong dollars.
Bookings made will receive an email once payment has been processed.

Cancellations & transfers

Confirmed bookings may not be cancelled or changed, and the tuition fee are non-refundable in any circumstances. However, bookings are freely transferable to your friends for the same lesson, thus you are welcome to send someone else in your place.

There is minimum number apply to run group lesson. If it is not met, the group lesson will be cancelled. At least 48 hours’ notice via phone / email will be given and a choice of rescheduling or a full refund will be offered.

If a lesson is cancelled due to circumstances beyond the control of Abigailswim.com, Abigailswim.com is not responsible for any costs, damages or expenses that you may suffer or incur. Refund will be given in accordance with our prevailing refund policy at such time.

Abigailswim.com reserves the right, at our sole discretion, to refuse service to anyone for any reason at any time.

Cancellation and Make-up class policy

GROUP SESSION

One make-up class, either casual leave or sick leave, can only be arranged upon the successful registration of one full term. The make-up class MUST be taken before the last day of the term. The make-up class must be at another time other than the student’s scheduled lesson time. Once a make-up class has been confirmed, no further change is allowed. Parents/ guardians should notify the booking office regarding the student’s absence in 24hrs advance. No make-up class will be arranged for absence without prior notice. No refund or credit will be applied for any unattended lessons.

PRIVATE SESSION

By Pay Advance (10 sessions) is valid for 90 days, counting from the purchase date, with 2 “Cancellation” vouchers included. Cancellation can be made prior to class starting in 24hrs, can use the “Cancellation” Voucher to exchange class credit. For any cancellation made less than 24hrs no make-up class or class credit would be given.

Abigailswim.com reserves the right to cancel the lessons, subject to below situations .

Coach arrangement: Make-up classes will be scheduled where possible. NO REFUNDS OR CREDITS WILL BE ISSUED.

Special occasions: No make-up classes will be offered. NO REFUNDS OR CREDITS WILL BE ISSUED.

Sick leave: 3 hours before the lesson (Original doctor or registered Chinese medicine practitioner’s note with an indication of the time period is compulsory.)

Cancellation: At least 24hours before the lesson begins.

Venues

Participation in activities at various private club has their policies. These policies are outlined on the application form. When registering your child at a private club, please ensure you read the club policies, which supersede those of Abigail Swim.

Abigail Swim reserves the right to cancel courses due to insufficient enrolment. All efforts will be made to place students in a similar course. If none is available, a refund will be issued.

Safety

Abigail Swim is not responsible for any injury to participants or damages or loss of property as a result of participation in our courses.
In case of a medical emergency, your child will be transferred to the nearest government hospital using the Hong Kong Government Emergency Medical Unit.

Trademarks and Registered Trademarks

Apple, the Apple logo, Mac OS are trademarks of Apple inc., registered in the U.S. and other countries.

Google Pay and the Google Pay Logo are registered trademarks or trademarks of Google, Inc.

Privacy Policy Statement

1. Statement of Policy

At Ellabook Ellabook Cloud Technology Limited, trading as abigailswim.com and Aquabubble, located at Unit 9, 25/F, Clifford Centre, No.778-784 Cheung Sha Wan Road, Kowloon, Hong Kong, we are committed to meeting fully recognized standards of personal data privacy protection. Our policy is to comply with the applicable requirements of the Personal Data (Privacy) Ordinance (PDPO) and to ensure our staff meets the security and confidentiality standards prescribed by law.

2. Collection and Use of Personal Data

We collect personal data via website forms and in-person, which may include your name, email address, home address, phone numbers, children’s names, their school name, and the area you live. This information is primarily used to facilitate the booking of classes, create tailor-made swimming programs, and organize group swimming classes and events on our platforms abigailswim.com and Aquabubble.

The provision of personal data is generally voluntary unless otherwise specified. Failure to provide the requested personal data or the provision of inaccurate or incomplete information may result in our inability to process your request or provide our services effectively.

3. Disclosure of Personal Data

In providing our services, personal data held by us may be disclosed to swimming coaches and event organizers who work with us. We will not disclose your personal data to any other third parties unless such disclosure is permitted or required by law.

4. Personal Data Retention

We retain the personal data we collect for a period of 2 years. We take all reasonably practicable steps to ensure that personal data will not be kept longer than necessary unless retention is otherwise permitted or required by law.

5. Security of Personal Data

We take appropriate steps to protect personal data against loss, unauthorized access, use, modification, or disclosure. All personal data provided to us on our website is secured.

6. Access and Correction/Enquiries

You have the right to request access to and correction of your personal data held by us in accordance with the provisions of the PDPO. You may do this via our Customer Online Portal.

Any enquiries regarding personal data, or requests for access to or correction of personal data, can be made to our support team via email at support@abigailswim.com.

By using our services, you agree to the collection and use of information in accordance with this policy. This Privacy Policy is subject to change, and any changes will be posted on this page.

PARENT AND GUARDIAN RESPONSIBILITIES

All students must be under adult supervision while waiting for classes to commence. Parents and guardians who wait on site are required to remain at the venue of the activity.

All classes will finish on time. Please ensure your child is picked up promptly after the class. Parking is not available at all venues and therefore, public transportation is recommended. Please Click Here for link to Public Transport websites.

BAD WEATHER ARRANGEMENT

1. Universal Policy:

All bad weather arrangements mentioned below apply to all venues where Abigail Swim operates.

2. Typhoon Warning Signal No.8 or Higher:

All classes scheduled for the day will be cancelled.

Students will receive a Credit Voucher which can be used for future bookings, payments, or as a refund if they prefer. Refunds for accumulated Credit Vouchers will be processed at the end of each term.

3. Black Rainstorm Warning Signal:

All classes scheduled for the day will be cancelled.

4. Amber or Red Rainstorm Warning Signal:

Classes will proceed as scheduled unless otherwise notified. If a class is cancelled, students will be offered a make-up class.

5. Weather Cancellations by Abigail Swim:

Abigail Swim reserves the right to cancel classes if a venue is deemed unsafe due to severe weather. Students will receive a Credit Voucher for such cancellations.

WAIVER

Abigail Swim aim to provide a fun safe environment for our participants to Learn to Swim, while we aim to reduce hazards in and around our facility, not all risks can be removed. We warn you that, while on our premises, you and your child/ children may be exposed to certain risks.

Parental Supervision is required at all times, and all participants must be actively supervised by a caregiver, and have a caregiver present at all lessons (Must not be dropped off and left)

The pool area is only supervised during structured swim tuition. We accept no responsibility for children outside scheduled lesson times. No children who are undertaking swim lessons are to remain in the pool area after their lesson has been completed.

Jumping, running, or diving is prohibited unless authorized by a Abigail Swim staff member.

You must follow all rules, signs and directions from Abigail Swim staff members for your own safety in our facility.

By agreeing into this Agreement and on every occasion you and your child/ children use our facilities you acknowledge and accept our warning of risk of injuries set out above and that you or child/ children in your care is subject to the risk of injury and release us from all liability.
